END USER LICENSE AGREEMENT (EULA)

PryPix Digital Products Platform

This End User License Agreement (“Agreement” or “EULA”) is a legally binding agreement between you (“User,” “Buyer,” or “Licensee”) and PryPix (“Platform,” “we,” “us,” or “our”) governing your access to and use of digital products, software, files, and content made available through the PryPix platform.

By downloading, accessing, installing, purchasing, or using any digital product obtained through PryPix, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not use or access any digital product provided through PryPix.

1. Scope and Purpose of This Agreement

This Agreement governs:

  • Digital products sold or distributed through PryPix
  • Software, scripts, plugins, themes, applications, and source code
  • Documentation, updates, patches, and related materials
  • Both free and paid digital items

This Agreement applies in addition to the PryPix Terms & Conditions, Privacy Policy, and other applicable policies. In the event of a conflict, license-specific terms (including GPL licenses) shall prevail over this EULA.

2. License Grant

2.1 General License

Unless otherwise stated, PryPix grants you a limited, non-exclusive, non-transferable, revocable license to access and use the digital product strictly in accordance with this Agreement and the license terms specified by the product vendor.

2.2 License Is Not Ownership

All digital products are licensed, not sold. This Agreement does not transfer ownership, intellectual property rights, or title to any software or digital product.

2.3 License Variations

Different products may be offered under different license models, including but not limited to:

  • Personal-use licenses
  • Commercial-use licenses
  • Extended or multi-use licenses
  • GNU General Public License (GPL) v2 or v3

Each product description defines the applicable license.

3. GPL-Licensed Software (GPL v2 and GPL v3)

3.1 GPL Supremacy

If a digital product is licensed under GNU General Public License v2 or v3, the terms of the GPL override and supersede this EULA where applicable.

3.2 Rights Under GPL

GPL-licensed products grant you the right to:

  • Use the software for any purpose
  • Study and modify the source code
  • Redistribute the software
  • Distribute modified versions

All such rights are governed strictly by the GPL license terms.

3.3 GPL Compliance

You agree that when redistributing GPL software, you will:

  • Preserve copyright notices
  • Include the applicable GPL license
  • Provide source code or a valid offer when required
  • Not impose additional restrictions

PryPix does not restrict any rights guaranteed by GPL licenses.

4. Restrictions for Non-GPL Products

Unless explicitly permitted by the product license, you may not:

  • Redistribute or resell the product as-is
  • Claim authorship or ownership
  • Share download links or license keys
  • Use the product to create competing marketplaces
  • Circumvent technical protections
  • Use the product unlawfully

Violations may result in license termination.

5. Vendor Responsibility and Third-Party Content

5.1 Vendor-Provided Products

Digital products are provided by independent vendors. PryPix does not author, modify, or control vendor content unless explicitly stated.

5.2 No Endorsement

PryPix does not endorse, warrant, or guarantee vendor products.

5.3 Third-Party Components

Some products may include third-party libraries or dependencies governed by separate licenses. You are responsible for complying with those licenses.

6. Updates, Modifications, and Support

6.1 Updates

Vendors may provide updates at their discretion. PryPix does not guarantee future updates unless explicitly stated.

6.2 Support

Support obligations, if any, are defined by the vendor. PryPix does not guarantee technical support unless expressly offered.

7. Intellectual Property Rights

All copyrights, trademarks, trade secrets, and other intellectual property rights in digital products remain with the vendor or original copyright holder.

This Agreement grants no rights beyond those explicitly stated.

8. User Obligations

You agree to:

  • Use digital products lawfully
  • Comply with all license terms
  • Not misuse or abuse the platform
  • Not upload malicious code
  • Not infringe third-party rights

Failure to comply may result in termination.

9. Termination

9.1 Termination by PryPix

This Agreement terminates automatically if you violate its terms.

9.2 Effect of Termination

Upon termination, you must cease using the digital product unless continued use is permitted under GPL terms.

Termination does not limit PryPix’s legal remedies.

10. No Warranty

10.1 “AS IS”

ALL DIGITAL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND.

10.2 Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES—EXPRESS OR IMPLIED—ARE DISCLAIMED, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRYPIX SHALL NOT BE LIABLE FOR:

  • LOST PROFITS
  • BUSINESS INTERRUPTION
  • DATA LOSS
  • INDIRECT OR CONSEQUENTIAL DAMAGES
  • SOFTWARE FAILURES

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT, IF ANY.

12. Indemnification

You agree to indemnify and hold harmless PryPix from any claims arising from:

  • Your use of digital products
  • License violations
  • Intellectual property infringement
  • Legal or regulatory violations

13. Refunds and Chargebacks

Refunds are governed by the PryPix Terms & Conditions. Unauthorized chargebacks may result in license termination and account suspension.

14. Export and Legal Compliance

You agree to comply with all applicable export laws, regulations, and restrictions. You may not use or distribute products in violation of applicable laws.

15. Governing Law and Disputes

This Agreement is governed by applicable law. Any disputes shall be resolved according to the dispute resolution provisions in the PryPix Terms & Conditions.

16. Severability

If any provision of this Agreement is held unenforceable, the remaining provisions remain in effect.

17. Entire Agreement

This Agreement, together with applicable licenses and PryPix policies, constitutes the entire agreement regarding digital product usage.

18. Acceptance

By downloading, installing, purchasing, or using any digital product from PryPix, you acknowledge that you have read, understood, and agreed to this EULA.
