1. Introduction and Scope
This DMCA Policy applies to PryPix and its users, including vendors, buyers, visitors, and third-party contributors. PryPix operates as an online digital marketplace where third-party vendors may upload, sell, distribute, or otherwise make available digital products, including software, digital assets, and other downloadable content. PryPix provides the platform infrastructure and does not claim ownership over user-uploaded content. PryPix is not a publisher, author, or creator of third-party content. This DMCA Policy is designed to provide a framework for handling claims of copyright infringement and to comply with the requirements of the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws.
This DMCA Policy is an integral part of PryPix’s legal framework and should be read in conjunction with the Privacy Policy, Terms and Conditions, and other applicable policies. Users agree to comply with this DMCA Policy as a condition of accessing and using the PryPix platform. Users who do not agree with this DMCA Policy should discontinue use of PryPix immediately.
This DMCA Policy applies to all content on the PryPix platform, including but not limited to product listings, product descriptions, digital downloads, images, video content, software code, templates, and other user-generated content. The policy also applies to communications and messages transmitted through PryPix, including vendor-to-customer and customer-to-vendor messaging.
The DMCA Policy is not intended to supersede the rights and obligations of users under other laws or policies. PryPix reserves the right to remove or disable access to any content that PryPix reasonably believes to be infringing or in violation of this policy. PryPix also reserves the right to terminate or restrict accounts that repeatedly violate this policy or that are found to be involved in copyright infringement.
This policy is designed to protect the rights of copyright holders while also safeguarding the rights of PryPix users who may legitimately use, modify, or distribute content under lawful licenses, including the GNU General Public License versions 2 and 3 (GPL v2 and GPL v3). PryPix does not claim to be the final authority on copyright ownership. PryPix does not investigate or verify the accuracy of claims beyond what is required by law. PryPix relies on good faith reporting and compliance by both copyright owners and users.
2. Definitions
For the purpose of this policy, the following definitions apply:
“Copyright” means the legal right of an author or copyright holder to control the reproduction, distribution, public display, public performance, and creation of derivative works of their original creative works, as defined by applicable copyright laws.
“Copyright owner” means the individual or legal entity that holds the rights to the copyrighted work or is authorized to act on behalf of the copyright holder.
“Copyright infringement” means the unauthorized copying, distribution, public display, public performance, or creation of derivative works of copyrighted material without permission or a valid license.
“DMCA notice” means a written statement provided by a copyright owner or authorized representative that identifies allegedly infringing material and requests removal or disabling of access to that material.
“Counter-notice” means a written response provided by a user whose content has been removed or disabled, asserting that the content is not infringing or that the user has a lawful right to use the content.
“Repeat infringer” means a user who has been notified multiple times of copyright infringement and continues to upload or distribute infringing content.
“Service provider” means PryPix in its role as a digital marketplace and platform provider, which may host or link to third-party content.
“Notice and takedown” means the process of submitting a DMCA notice and the subsequent removal or disabling of access to allegedly infringing content, followed by possible counter-notice and reinstatement.
“Copyrighted work” means any original work protected by copyright law, including software, code, digital art, text, images, music, video, templates, and other digital assets.
“Authorized representative” means an individual or entity authorized by the copyright owner to submit a DMCA notice on behalf of the copyright owner.
3. DMCA Compliance and Platform Responsibility
PryPix is committed to complying with applicable copyright laws, including the DMCA, and to maintaining a fair and lawful marketplace environment. PryPix provides a mechanism for copyright owners to report infringing content and for users to respond to such reports. PryPix acts as a neutral platform and does not endorse or verify claims beyond what is required by law. PryPix does not independently investigate or verify the truthfulness of claims unless required by law or as part of a formal legal process.
PryPix may, at its discretion, remove or disable access to content that is allegedly infringing or that violates this DMCA Policy. PryPix may also remove or disable access to content when PryPix receives a valid DMCA notice or when PryPix has reason to believe that the content is infringing or illegal. PryPix may also remove content when PryPix receives notice from third parties, including vendors, users, or government entities.
PryPix may also take proactive steps to reduce the risk of copyright infringement, including implementing automated scanning systems, monitoring for repeated infringement, and limiting uploads from accounts with a history of infringement. PryPix may also require additional verification or documentation from users who submit repeated or suspicious content.
PryPix reserves the right to take action against accounts that violate this DMCA Policy, including temporary suspension, account termination, or banning from the platform. PryPix may also restrict access to certain features for accounts that are flagged for repeated infringement.
PryPix does not guarantee that any content removed under this policy is actually infringing. PryPix acts in good faith to comply with copyright law, but PryPix is not responsible for errors in removal or reinstatement. Users who believe their content has been wrongly removed may submit a counter-notice as described in this policy.
PryPix is not responsible for any damages or losses arising from the removal or disabling of access to content, including loss of revenue, reputation, or other losses. Users acknowledge that PryPix is not a publisher or author of third-party content and is not liable for the actions or omissions of third-party users.
4. How to Submit a DMCA Notice
To submit a DMCA notice, the copyright owner or authorized representative must provide a written notice that includes all required information. A valid DMCA notice must be submitted in writing and must include the following elements:
A physical or electronic signature of the copyright owner or authorized representative.
Identification of the copyrighted work that is allegedly infringed, including a description of the copyrighted work.
Identification of the allegedly infringing content, including a specific URL or link to the location on PryPix where the content is posted. The notice must provide sufficient detail for PryPix to locate the content.
A statement that the copyright owner has a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notice is accurate and that the copyright owner is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
A statement that the copyright owner understands that the notice may be subject to penalties for perjury or false statements.

PryPix may also provide a designated DMCA reporting form or email address for DMCA notices. Users should use the designated channel and ensure that all required information is included. PryPix may reject DMCA notices that are incomplete or that do not meet the requirements of this policy.
PryPix may also require additional documentation or verification if the notice appears incomplete, suspicious, or not credible. PryPix may also require proof of ownership or authorization to act on behalf of the copyright owner.
5. What Happens After a DMCA Notice is Received
After receiving a valid DMCA notice, PryPix will take appropriate action to remove or disable access to the allegedly infringing content. PryPix will also notify the user who posted the content (the “accused user”) and provide them with information about the notice and the process for responding.
PryPix will act in a timely manner to remove or disable access to the content to comply with the DMCA’s safe harbor requirements. PryPix will not assume responsibility for determining the validity of the claim beyond the information provided in the notice.
PryPix may also preserve evidence or records related to the notice, including communications, user information, and the content itself. PryPix may also provide information to legal authorities or third parties if required by law.
PryPix may also take additional steps, including limiting the accused user’s ability to upload or publish content, restricting account access, or placing the account under review.
PryPix will not reinstate content until the counter-notice process is complete or until the copyright owner withdraws the notice.
PryPix may also keep a record of DMCA notices and counter-notices for compliance and auditing purposes. PryPix may also use the record to identify repeat infringers and to implement further protective measures.
6. Counter-Notice Process
Users whose content has been removed or disabled may submit a counter-notice if they believe the content was removed in error or if they believe they have a lawful right to use the content. A valid counter-notice must include the following:
The user’s name, address, telephone number, and email address.
Identification of the content that was removed or disabled, including the specific URL or link.
A statement under penalty of perjury that the user has a good faith belief that the content was removed due to mistake or misidentification.
A statement consenting to the jurisdiction of the user’s local federal court or the court where the user resides, and agreeing to accept service of process from the copyright owner.
The user’s physical or electronic signature.
The counter-notice should be submitted through the designated PryPix channel for counter-notices. PryPix will forward the counter-notice to the copyright owner and will consider reinstating the content after the required waiting period.
PryPix may also require additional information or verification if the counter-notice appears incomplete or suspicious. PryPix may reject counter-notices that do not meet the requirements of this policy.
PryPix may reinstate the content if the copyright owner does not take legal action within the required timeframe. PryPix may also reinstate the content if the copyright owner withdraws the DMCA notice.
PryPix may also notify the user if the counter-notice is rejected or if additional information is required.
7. Repeat Infringer Policy
PryPix has a zero-tolerance policy for repeat copyright infringement. PryPix will monitor accounts for repeated copyright violations and may terminate or suspend accounts that repeatedly infringe copyright. PryPix reserves the right to permanently ban repeat infringers from the platform.
PryPix may also restrict access to certain features or content for accounts flagged for repeated infringement. PryPix may also remove content that is suspected of infringement even if a DMCA notice has not been submitted.
PryPix will take reasonable steps to identify repeat infringers, including tracking DMCA notices, reviewing content uploads, and monitoring user behavior.
PryPix may also require additional verification for accounts that have a history of infringement, including verifying identity or requiring proof of ownership for uploaded content.
8. GPL Licensing and DMCA
PryPix supports lawful open-source distribution, including GPL v2 and GPL v3 licensed software. Users may upload and distribute GPL-licensed software in compliance with the GPL license terms. PryPix does not claim ownership over GPL-licensed software, and PryPix will not interfere with the lawful distribution of GPL software.
Copyright owners may still submit DMCA notices if GPL terms are violated or if content is otherwise infringing. PryPix may remove content if it violates GPL terms or if it is otherwise infringing.
PryPix encourages users to comply with GPL requirements, including providing source code and license notices where applicable. PryPix may require vendors to provide GPL compliance documentation when distributing GPL software.
PryPix does not provide legal advice. Users are responsible for ensuring compliance with GPL license terms and other applicable laws.
9. Vendor Responsibility and Platform Use
Vendors who sell digital products on PryPix must ensure that their products do not infringe copyright and comply with all applicable laws. Vendors must ensure that they have the rights to distribute the products they upload. Vendors must also ensure that product descriptions, images, and documentation are accurate and do not misrepresent ownership.
Vendors are responsible for maintaining proper licensing and compliance for digital products, including GPL software. Vendors must also comply with PryPix’s policies and applicable laws.
Vendors must respond to DMCA notices and cooperate with PryPix in resolving disputes. Vendors who repeatedly infringe copyright may have their accounts suspended or terminated.
10. Section 2: Notice Requirements and Takedown Procedures
10.1 Required Elements of a Valid DMCA Notice
- To initiate a valid DMCA takedown request, the copyright owner or authorized representative must provide a written notice that includes the following elements. PryPix may reject incomplete or unclear notices. The notice must be submitted through the designated DMCA reporting channel. PryPix may require verification or clarification if the notice is incomplete.
- A physical or electronic signature of the copyright owner or authorized representative.
- Identification of the copyrighted work that is claimed to have been infringed, including a description of the copyrighted work.
- Identification of the allegedly infringing material that is located on PryPix, including the URL or link where the material is located.
- A statement that the copyright owner has a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement under penalty of perjury that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Contact information for the copyright owner or authorized representative, including name, address, phone number, and email address.
- A statement that the notice may be subject to penalties for perjury or false statements.
- PryPix may also request additional information to verify the identity of the copyright owner or the validity of the claim. PryPix may reject notices that contain incomplete or inaccurate information. PryPix may also reject notices that appear to be submitted in bad faith or for harassment.
- 10.2 How to Submit a DMCA Notice
- A DMCA notice must be submitted to PryPix using the official reporting mechanism. PryPix provides a dedicated contact method for DMCA notices to ensure proper handling. Users may submit DMCA notices through the PryPix Contact page. The PryPix contact page can be accessed here: PryPix Contact Us.
- PryPix may also provide a dedicated email address or form for DMCA notices. Users must use the designated channel to ensure the notice is received and processed. PryPix does not accept DMCA notices via social media, public comments, or other unofficial channels unless otherwise stated.
- PryPix may also provide a designated DMCA form to simplify the process. Users should ensure that the notice includes all required information. PryPix may reject notices that do not meet the requirements or that are submitted without proper authorization.
- 10.3 Notice Receipt and Confirmation
- Upon receiving a valid DMCA notice, PryPix will review the notice for completeness and accuracy. PryPix will then send a confirmation of receipt to the copyright owner or authorized representative. PryPix will also send a notice to the user whose content is alleged to be infringing (the “accused user”). The notice will include details about the alleged infringement and the steps the user may take to respond.
- PryPix will not disclose personal contact information of the accused user to the copyright owner, except as required by law. PryPix may share limited information necessary to process the notice or as required by legal process.
- 10.4 Takedown and Disabling Access
- After receiving a valid DMCA notice, PryPix will take appropriate action to remove or disable access to the allegedly infringing content. PryPix may also remove or disable access to associated product listings, downloads, or other content related to the alleged infringement.
- PryPix may also remove content that is found to be infringing even if no DMCA notice is received, based on internal review or user reports. PryPix may remove content that violates this DMCA Policy or other PryPix policies.
- PryPix may also take additional measures, such as restricting the user’s ability to upload or sell products, limiting access to certain features, or suspending the user’s account. PryPix may also place the account under review and may require additional documentation or verification.
- 10.5 Notification to the Accused User
- When PryPix disables access to content based on a DMCA notice, PryPix will notify the accused user. The notice will include:
- The identity of the claimant (copyright owner or authorized representative).
- The content that has been removed or disabled.
- The reason for removal.
- Information about the counter-notice process.
- The user’s right to submit a counter-notice.
- PryPix will also provide instructions for submitting a counter-notice. Users are encouraged to respond promptly if they believe the content was removed in error.
- 10.6 Preservation of Evidence
- PryPix may preserve evidence related to the DMCA notice, including copies of the content, logs, user information, and communications. PryPix may retain evidence for a reasonable period to support investigations, legal compliance, and internal audits.
- PryPix may also provide information to legal authorities or third parties if required by law or in connection with a formal legal process. PryPix may cooperate with law enforcement or other authorized entities as required.
- 10.7 Notice Withdrawal
- A copyright owner may withdraw a DMCA notice at any time. To withdraw a notice, the copyright owner must submit a written withdrawal request through the same channel used to submit the original notice. PryPix will review the request and may reinstate the content if appropriate.
- PryPix may also reinstate content if the copyright owner withdraws the notice or if the notice is found to be invalid. PryPix may also reinstate content if the accused user submits a valid counter-notice and the required waiting period expires.
- 10.8 Counter-Notice Requirements
- Users may submit a counter-notice if they believe the content was removed due to mistake or misidentification. A valid counter-notice must include:
- The user’s name, address, phone number, and email address.
- Identification of the content that was removed, including the URL or link.
- A statement under penalty of perjury that the content was removed by mistake or misidentification.
- A statement consenting to jurisdiction of the user’s local federal court or the court where the user resides.
- A statement agreeing to accept service of process from the copyright owner.
- The user’s physical or electronic signature.
- Users must submit counter-notices through the designated channel. PryPix may reject counter-notices that are incomplete or not credible.
- 10.9 Counter-Notice Process
- Upon receiving a valid counter-notice, PryPix will forward the counter-notice to the copyright owner. PryPix will inform the copyright owner that the content may be reinstated unless the copyright owner files a legal action within the required timeframe.
- PryPix will wait the legally required period before reinstating the content. If the copyright owner does not take legal action, PryPix may reinstate the content. PryPix will notify the user when the content is reinstated or if the counter-notice is rejected.
- PryPix may also require additional information or verification if the counter-notice appears suspicious or incomplete. PryPix may reject counter-notices that appear to be submitted in bad faith.
- 10.10 Expedited Takedown Requests
- In certain cases, PryPix may process expedited takedown requests, such as cases involving urgent copyright infringement or clear violations. PryPix may require additional documentation or verification for expedited requests.
- PryPix may also expedite takedown requests when required by law or when the infringement is clearly evident. PryPix may also expedite takedown requests when the content involves repeated infringement or high-risk violations.
- 10.11 Takedown Appeals and Dispute Resolution
- Users who believe their content was wrongly removed may submit a counter-notice or appeal the decision. PryPix will review appeals and may reinstate content if the appeal is valid.
- PryPix may also provide mediation or alternative dispute resolution mechanisms if available. PryPix may encourage parties to resolve disputes amicably. PryPix is not a legal arbiter and does not provide legal advice.
- 10.12 Vendor Responsibility in DMCA Disputes
- Vendors are responsible for ensuring that their products do not infringe copyright. Vendors must respond to DMCA notices and cooperate with PryPix. Vendors may be required to provide proof of ownership or authorization to distribute the content.
- Vendors may also be required to remove infringing products and may be prohibited from re-uploading infringing content. Vendors who repeatedly infringe may be suspended or terminated.
- Vendors must also ensure that their product descriptions and documentation accurately represent ownership and licensing. Vendors must also ensure compliance with GPL v2 and GPL v3 licensing when distributing open-source software.
- 10.13 Third-Party Licenses and DMCA
- PryPix supports lawful open-source licensing, including GPL v2 and GPL v3. Users may upload GPL-licensed software and distribute it in compliance with the GPL terms. PryPix does not interfere with lawful open-source distribution.
- However, GPL compliance violations may still result in DMCA notices if the content is infringing or misrepresented. PryPix may remove content that violates GPL terms or that is otherwise infringing.
- 10.14 Reporting Copyright Infringement by Third Parties
- Users may report suspected copyright infringement by third parties using PryPix’s reporting mechanism. PryPix may review the report and take appropriate action. PryPix may require additional information or evidence.
- PryPix may also forward reports to the relevant vendor or user. PryPix may also take action if the report indicates repeated infringement.
- 10.15 Prohibited Actions and Abuse of DMCA
- Abuse of the DMCA process is strictly prohibited. Users who submit false or misleading DMCA notices may be subject to penalties, including account suspension, termination, and legal action.
- Users who submit false counter-notices may also face penalties. PryPix may take action against users who misuse the DMCA process to harass or harm other users.
- 10.16 Limitations on PryPix Liability
- PryPix is not responsible for the accuracy of DMCA claims or counter-notices. PryPix acts as a neutral platform and is not responsible for damages resulting from content removal or reinstatement.
- PryPix is not liable for any loss of revenue, reputation, or other damages arising from DMCA takedown actions. PryPix’s liability is limited to the extent permitted by law.
- 10.17 Recordkeeping and Transparency
- PryPix maintains records of DMCA notices, counter-notices, and related actions. PryPix may use these records for compliance and internal review. PryPix may also share aggregated data about DMCA activity for transparency.
- 11. Counter-Notice Evaluation and Reinstatement Process
- When PryPix receives a valid counter-notice from a user, PryPix will conduct a preliminary evaluation to ensure that the counter-notice includes all required elements. A valid counter-notice must contain the user’s contact information, identification of the removed content, a statement under penalty of perjury that the content was removed by mistake or misidentification, consent to jurisdiction, acceptance of service of process, and the user’s signature. PryPix will verify that the counter-notice is complete and coherent and that it does not contain clearly false or misleading statements.
- PryPix will forward the counter-notice to the claimant who submitted the original DMCA notice. PryPix will also provide the claimant with the user’s contact information as required by law, unless otherwise prohibited by law or by a court order. PryPix will inform the claimant that the content may be reinstated unless the claimant files a legal action seeking a court order to prevent the user from posting the content. PryPix will also inform the user that the counter-notice has been forwarded to the claimant and that the claimant has a limited period of time to initiate legal action.
- If the claimant does not file a legal action within the legally required timeframe, PryPix will reinstate the removed content. PryPix will notify the user that the content has been reinstated and will provide details about the reinstatement. PryPix will also notify the claimant that the content has been reinstated and that no legal action was filed. PryPix will maintain records of the counter-notice, the claimant’s response, and the reinstatement for internal compliance and audit purposes.
- PryPix may also reject or delay reinstatement if the counter-notice is incomplete, if there is evidence of bad faith, or if the user is a repeat infringer. PryPix may require additional information from the user to verify identity or to confirm that the counter-notice is legitimate. PryPix may also request clarification if the counter-notice is ambiguous or unclear. PryPix will not reinstate content if the user fails to provide required information or if the counter-notice is not credible.
- 12. Misrepresentation and False Claims
- PryPix strictly prohibits misrepresentation in DMCA notices and counter-notices. Submitting a DMCA notice that contains false or misleading statements, or submitting a counter-notice with false information, may be considered an abuse of the DMCA process. Users who engage in misrepresentation may face account suspension, termination, and legal consequences. PryPix reserves the right to take disciplinary action against any user who submits a false notice or counter-notice.
- If PryPix has reason to believe that a DMCA notice is fraudulent, PryPix may refuse to process the notice and may report the matter to legal authorities. PryPix may also take action against users who repeatedly submit invalid or abusive notices. PryPix may also take action against users who attempt to use the DMCA process to harass or intimidate other users. PryPix will not tolerate misuse of the DMCA process as a tool for harassment, retaliation, or unfair competition.
- Similarly, users who submit false counter-notices may face consequences. PryPix may investigate counter-notices for signs of bad faith or misrepresentation. If PryPix determines that a counter-notice is fraudulent or submitted in bad faith, PryPix may reject the counter-notice and may take disciplinary action against the user. PryPix may also refuse to reinstate content and may impose account restrictions or termination.
- PryPix may also cooperate with legal authorities or third parties if the misuse of the DMCA process constitutes a criminal offense or if it involves fraud or harassment. PryPix may share relevant records, including notices, counter-notices, communications, and account information, with law enforcement as required by law. PryPix will maintain confidentiality and privacy to the extent permitted by law while complying with legal obligations.
- 13. Repeat Infringer Policy
- PryPix has a strict repeat infringer policy. PryPix will terminate the accounts of users who repeatedly infringe copyright or who repeatedly upload content that has been subject to valid DMCA notices. PryPix will also terminate accounts of users who repeatedly submit invalid or abusive DMCA notices. PryPix may also suspend accounts, restrict functionality, or place accounts under review for repeated infringement or repeated misuse of the DMCA process.
- PryPix may use internal monitoring tools, complaint records, and DMCA notice history to identify repeat infringers. PryPix may also rely on vendor reports and community feedback to detect repeated infringement. PryPix will review evidence and take action when necessary to protect the rights of copyright owners and to maintain the integrity of the platform.
- PryPix may also require repeat infringers to provide proof of authorization for future uploads. PryPix may restrict or prohibit uploads from users who have demonstrated repeated infringement or bad faith. PryPix may also require users to complete a verification process or to provide documentation confirming their rights to distribute content.
- PryPix may also impose penalties on vendors who repeatedly infringe or who repeatedly list infringing products. PryPix may remove vendor listings, restrict vendor access, or terminate vendor accounts. PryPix may also require vendors to provide proof of ownership or authorization before listing products. PryPix may also require vendors to maintain accurate licensing documentation and to comply with open-source license terms such as GPL v2 and GPL v3.
- 14. Vendor Obligations and Licensing Compliance
- Vendors on PryPix are responsible for ensuring that their products comply with all applicable laws and license terms. Vendors must ensure that their products do not infringe copyright or violate intellectual property rights. Vendors must also ensure that their product descriptions accurately reflect ownership, licensing, and authorized distribution.
- Vendors who sell or distribute open-source software must comply with the applicable open-source license terms. PryPix supports lawful open-source distribution, including GPL v2 and GPL v3. Vendors must provide all required source code, notices, and licensing terms when distributing GPL-licensed software. Vendors must also ensure that any modifications to GPL-licensed software are properly licensed and documented.
- Vendors must not misrepresent their rights to distribute GPL-licensed software or other open-source products. Vendors must not upload or distribute software that is licensed under GPL v2 or GPL v3 without complying with the license terms. Vendors must also ensure that any bundled components or third-party libraries comply with the applicable licenses. Vendors are responsible for any violations of license terms, including copyright infringement, and may be subject to removal of content, account suspension, or termination.
- Vendors must also maintain accurate records and documentation for their products. PryPix may request documentation to verify ownership or licensing. Vendors must respond promptly to DMCA notices and cooperate with PryPix in investigations. Vendors must also comply with PryPix’s policies and procedures for DMCA notices and counter-notices.
- 15. Platform Role and Neutrality
- PryPix operates as a digital marketplace and a service provider. PryPix does not create, own, or control the content uploaded by users or vendors. PryPix does not endorse or guarantee the legality of user-uploaded content. PryPix is not a publisher or author of user content. PryPix is a neutral platform that provides hosting, distribution, and payment services.
- PryPix acts as an intermediary and is not responsible for the accuracy or legality of user content. PryPix is not responsible for the actions of users or vendors. PryPix does not assume liability for copyright infringement by users or vendors.
